Cresta Manufacturing Limited trading as Scallywag Kids, is a company registered in England and Wales. Company registration number 15036741 with Registered office at Units 16 &17 Bankfield Business Park, Mirfield, West Yorkshire, WF14 9DD. The following information relates to the company (“We”, “Us” and “Our”) and the terms and conditions (“Terms”) upon which we sell the products (“Products”) listed on www.scallywagkids.co.uk (the “Website”) to you (“You”, “Your”).
Cresta Manufacturing Ltd endeavours to ensure that the information on this website is accurate and up to date but does not give any warranty as to its accuracy or completeness and will not be responsible for any errors or omissions or for the results arising from the use of such information.
We may change these Terms from time to time. Any such changes will take effect when posted on the Website and it is your responsibility to read these Terms on each occasion you order Products from us. Your continued use of the Website shall signify your acceptance to be bound by the Terms.
CONSUMER RIGHTS
This section is only applicable to individuals who order from us. It does not apply to business or commercial customers or individuals who purchase a product for business or commercial use.
You may cancel at any time before despatch of your order and within 14 days of receipt of the order, beginning on the day after you receive the products.
To aid a safe return journey, we would advise that the original packaging is used. We cannot refund items which have been assembled, so please consider the dimensions provided before placing an order. The return carriage will be at your own cost. If you wish to use our carrier for the return, the cost will be deducted from your refund plus the carrier’s £30 surcharge for third party collection. The original carriage charge will also be deducted from your refund. Our re-stock cost of £20 will also be deducted from the refund.
Please note that for hygiene reasons, we cannot accept the return of mattresses or sheets if they have been unwrapped unless there is a quality issue.
PRODUCTS AND SERVICES
All product descriptions are correct at the time of publication on our site. We reserve the right to amend the specification of products without notice in regard to future purchases.
Measurements provided are as accurate as possible but are nonetheless approximate.
Finishes are applied to our products. Due to the nature of the materials used, finishes may vary.
The photography used on the Website is for illustrative purposes only and may not exactly match the Products themselves. Colours may vary from pictures due to lighting conditions, however we are happy to supply colour samples on request. Any major differences have been noted in the Product information. Where the photography shows other furnishings and items in the picture, other than the product detailed in the description, these are not included unless specifically stated in the Product information
Stock availability and any information provided in subsequent communication are provided in good faith and accurate at the time they are given but are not guaranteed.
It is your responsibility to check that all details provided on the order are correct, including the specifications of the products and delivery details.
PRICING AND PAYMENTS
We take all reasonable care to ensure that the prices of Products on the Website are correct at the time when the relevant information was entered onto the system. It is always possible that, despite our reasonable efforts, some of the Products on our Website may be incorrectly priced. If we discover an error in the price of the Products you have ordered we will inform you of this error and we will give you the option of continuing to purchase the Product at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing.
All orders placed on the website will have payment taken in full at the time the order is placed. Should you wish to pay a deposit only, with the balance due before despatch, please call us to place your order (01924 497598).
Prices include VAT but exclude any delivery costs to the Scottish Highlands or to locations off mainland UK.
Payments We accept Paypal, Klarna, Clearpay and all major debit/credit cards via our secure website and secure payment processor Stripe.
DELIVERY
Please refer to our Delivery Information page for full details on the delivery service.
It is the responsibility of the person accepting the delivery to check the condition of and number of packages before signing the courier’s consignment note. If there is any indication of damage to any packages, the consignment must be signed for as ‘Damaged’ & photographs of the packaging and any affected items emailed within 48 hours to: sales@scallywagkids.co.uk
We cannot accept liability for missing or damaged items if the delivery has been signed for as complete and in good condition.
We will not be liable for any direct or indirect loss of profits or other financial loss or damage suffered by you through any delay in delivery or due to goods arriving damaged.
GUARANTEE
All of our furniture is covered by our 24 month guarantee. This is from the date you receive the goods and covers faults arising from poor workmanship or other manufacturing defect and / or the use of faulty materials. It does not cover normal wear & tear, neglect, misuse or failure to follow the care instructions supplied with each product.
This guarantee is in addition to, and does not affect, statutory rights.
Please note that natural wood may darken over time & knots may appear more prominent; any such changes to the appearance are not deemed a fault and therefore are not included under terms of the guarantee.
Guarantees only apply to goods delivered to mainland UK. If the goods are removed from mainland UK and you wish to claim under the terms of the guarantee, you will be responsible for any additional shipping costs.
LIABILITY
We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when you commenced using the Web site or when a contract for the sale of goods by us to you was formed.
Our total liability in respect of all losses arising under or in connection with the Contract, whether in contract, tort (including negligence), breach of statutory duty or otherwise (directly or indirectly), shall in no circumstances exceed the price of the Product(s).
Cresta Manufacturing Ltd. does not limit in any way our liability by law for death or personal injury caused from our negligence or breach of duty.
GOVERNING LAW AND JURISDICTION
These conditions are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the non-exclusive jurisdiction of the English courts.
